1 DEFINITIONS

 

1.1 R4G or ‘Recruit4good” Jobs’ or ‘Us’

Employer-jobseeker introduction service being delivered by the charity Anxious Minds

1.2 ‘You’ or ‘Your’ (‘you’ or ‘your’) or ‘User’

Users of the R4G website.

1.3 ‘R4G website’ or ‘Our website’

Recruit4good Jobs website owned and managed by the Anxious Minds, a charitable incorporated organisation registered in England and Wales with registered charity number 1164040.

1.4 ‘Services’

Services and information provided on the R4G website by us, Employers and our third-party suppliers intended to assist in the job seeking, training or recruitment process.

1.5 ‘Our partners’

Recruit4good (R4G) website is being delivered by a team of other job boards part of a group of recruiters working in partnership with JOBBOAURDS.COM

1.6 ‘User’

Someone registered to use the Services of the R4G website.

1.7 ‘Ts & Cs’

Contents on this page.

1.8 ‘Staff’

A person employed by the Employer.

1.9 ‘Job seeker’

Person, spouses, partners and adult children, aged 18-25,who are looking for employment.

 

1.10 ‘Applicant’

Someone who meets the criteria as an R4G Job seeker who has registered on the R4G website and applied for an advertised position.   

1.11 ‘Employer’

In the context of this service, an Employer is a company or organisation and has registered with the R4G website to offer positions to Job seekers.

1.12 ‘Third-party supplier’

An accredited training partner who offers their services via our website.

2 TERMS OF USE

Recruit4good Jobs website (R4G) is being delivered by charity Anxious Minds

Recruit4good Jobs website (“R4G website”) is owned and operated by Anxious Minds (R4G), a charitable incorporated organisation registered in England and Wales with registered charity number 1164040.

The R4G website is made available to you on the following terms and conditions. By using the R4G website and the Services available on it you are deemed to accept these terms and conditions and any additional terms and conditions which expressly apply to Services and information provided by third-parties.

The following terms & conditions (Ts & Cs) govern your use of the R4G website.

R4G reserves the right to change or update our Ts & Cs at any time, so please do check this page regularly. Your continued use of the site constitutes your acceptance of any changes made.

3 DATA PROTECTION

Our use of CVs and other personal data supplied by users of this site is governed by our Privacy Policy. View our privacy policy. 

4 GENERAL TERMS

4.1 Use of the R4G website

4.1.1 The information and Services available on the R4G website are provided for the sole purpose of individuals looking for employment opportunities and career information, AND/OR for Employers seeking to recruit staff. You may use, print and download information from the site for these purposes only and for no other personal or commercial purpose. You may not otherwise copy, display, transmit or distribute any material from the site. 

4.1.2 All copyright, database rights and other intellectual property rights in the site and the material available on the site belongs to R4G or its third-party suppliers. Use of the R4G website does not give you any proprietary rights in such materials. You agree not to deep-link and/or frame the R4G website or any of the Services for any purpose, unless specifically authorised by R4G to do so.

4.1.3 R4G will permit the Job-seeker and Employer to access, use and interact with the R4G website subject to these terms and conditions. Any party using this service for any purpose other than those specifically stated in these Ts & Cs shall immediately be banned from using this website.

4.1.4 We try to ensure continuous availability of the site and all the Services available on it but accept no responsibility for the consequences of interruptions or delays, however caused. All liability of R4G, its directors, officers or employees howsoever arising for any loss whatsoever arising from your use of or inability to use the R4G website and/or the Services is excluded, insofar as it is possible to do so in law. We may, additionally, alter the design and specification of the R4G website at any time.

4.1.5 Job seekers and Employers need to be aware that R4G does not introduce, recommend or supply Job seekers to Employers (or vice versa). It is recommended that, if you are a Job seeker to ensure your suitability for the role advertised or, if you are an Employer, to ensure a Job seeker's suitability for the role you should undertake the steps set out in The Conduct of Employment Agencies and Employment Business Regulations 2003 and any of its subsequent amendments.

4.1.6 You agree that you shall not use the R4G website or the Services to transmit or knowingly or recklessly receive (or knowingly or recklessly authorise or permit any other person to receive or transmit) material which is obscene, threatening, menacing, offensive, defamatory, abusive, untrue, in breach of confidence, in breach of any intellectual property right (including copyright) or which may cause anxiety to others including racist or sexist content or material which otherwise violates any applicable law or regulation or code, or which makes excessive demands for bandwidth or contains any virus or which may otherwise impair or harm R4G computer systems or any third-party computer system.

4.1.7 Save to the extent possible by law R4G does not warrant that our website or Services will operate without error or that the site or Services are free from infection by viruses or anything else which has contaminating or destructive properties and R4G and its Partners shall have no liability in respect thereof.

4.1.8 Save to the extent required by law, no representations, warranties or terms of any kind are made in respect of the R4G website and/or the Services or their contents (including, without limitation, any views or comment made). All information and/or data included in and/or on the R4G website, the Services and/or in any directory or other listings or information retrieval service made available on or by the R4G website and/or the Services has been so made available for guidance only. In addition, R4G makes no representations or warranties about the accuracy, completeness, or suitability for any purpose of the information and related graphics published in this site. The information contained in this site may contain technical inaccuracies or typographical errors. Your use of such information and/or data is therefore entirely at your own risk. All liability of R4G, its directors, employees or other representatives howsoever arising for any loss suffered as a result of your use of the website and/or the Services is expressly excluded to the fullest extent permitted by law.

4.1.9 Notwithstanding the foregoing, none of the exclusions and limitations in these terms are intended to limit any rights you may have as a consumer under local law or other statutory rights which may not be excluded nor in any way to exclude or limit R4G liability to you for death or personal injury resulting from our negligence or that of our employees or agents.

4.1.10  Our website contains links to third-party websites. These links are provided solely as a convenience to you and not as an endorsement by R4G of the contents on such third-party web sites. R4G is not responsible for the content of linked third-party sites and does not make any representations regarding the content or accuracy of materials on such third-party web sites. If you decide to access linked third-party web sites, you do so at your own risk FURTHERMORE you acknowledge that R4G is not responsible for third-party content on the R4G website and that R4G cannot ensure that material presented on the Internet is legal. R4G will not limit access to material unless notified that it is illegal. In particular, you acknowledge that R4G is not responsible for and does not monitor the content of job postings provided by third parties on the R4G website. However, R4G shall have the right to remove any postings, materials or other items on the R4G website which it believes may be illegal or which it determines to be inappropriate.

4.1.11 You agree to defend, indemnify, and hold harmless R4G, its affiliates, and their respective officers, directors, employees and agents, from and against any claims, actions or demands, including without limitation reasonable legal and accounting fees, alleging or resulting from (i) any user-content or other material you provide to any R4G website, (ii) your use of any R4G content, or (iii) your breach of these Ts & Cs.  R4G shall provide notice to you promptly of any such claim, suit, or proceeding.

4.1.12 These Ts & Cs will remain in full force and effect while you are a User of any R4G site. R4G reserves the right, at its sole discretion, to pursue all of its legal remedies, including but not limited to removal of your user-content from the R4G website and immediate termination of your registration with, or ability to access the, R4G website and/or any other Services provided to you by R4G, upon any breach by you of these Ts & Cs or if R4G is unable to verify or authenticate any information you submit to a R4G website registration. Even after you are no longer a User of the R4G website, certain provisions of these Ts & Cs will remain in effect. R4G may terminate, suspend or deny you access to the R4G website and/or Services immediately for any reason without incurring any liability whatsoever to you.

4.1.13 Where you are asked to complete a registration form the personal details that you provide must be true, accurate and complete. You agree to notify us of any changes which are relevant to your registration.

4.1.14 If you choose to use our Services, your personal data may be collected and processed by R4G. R4G processes personal data in accordance with its Privacy Policy  which you should read carefully before deciding to provide your personal data to us. Please be aware that depending on the way in which you choose to use our Services, we may share your personal data with third parties in order to deliver those Services. Our Privacy Policy explains how, when and why we process personal data, who we share it with, how we keep it secure and how long we keep it for as well as your rights as a data subject. 

4.1.15 Failure or neglect by either party to exercise or enforce any right conferred shall not be deemed to be a waiver of any such right nor operate so as to bar that exercise or enforcement thereof or of any other right on any later occasion.

4.1.16 If any provision of the Ts & Cs or part thereof is determined to be invalid, unlawful or unenforceable, such provision, or part thereof, shall be severed from the remaining terms, conditions and provisions which shall continue to be valid and enforceable to the fullest extent permitted by law.

4.1.17 This Agreement constitutes the entire agreement between the parties in respect of its subject matter NOTWITHSTANDING that R4G reserves the right to vary this Agreement from time to time (including the Services offered by R4G). Such changes shall be posted on the R4G website. Changes in this manner shall be deemed to have been accepted if you continue to use the R4G website and/or the Services after a period of two weeks from the date of posting on the R4G website.

4.2 Employment Agencies & Employment Business Regulations 2003 and subsequent amendments

4.2.1 Job seekers and Employers need to be aware that this job board operates as a venue only and does not introduce, recommend or supply Job-seekers to Employers (or vice versa). This means that we do not:

4.2.1.1 obtain sufficient information for potential Employers to select a suitable Job-seeker for the position which the Employer seeks to fill;

4.2.1.2 obtain confirmation of the identity of a Job seeker and that they have the experience, training, qualifications or authorisation to work in the position to be filled or that they wish to undertake the role to be filled;

4.2.1.3 take any steps to ensure the Job seeker and Employer are each aware of any requirement imposed by law or otherwise which must be satisfied by either of them to permit the Job seeker to fulfil the position to be filled, including the rights that the Job seeker may have to take up work in the UK or other country or territory as may be appropriate;

4.2.1.4 take any steps to ensure that it would not be detrimental to the interests of the Job seeker or the Employer for the Job seeker to take up the position to be fulfilled;

4.2.1.5 give any indication to Employers whether Job-seekers are unsuitable (or suitable) for any position to be filled in any circumstances;

4.2.1.6 propose Job seekers to Employers or provide any information about them.

4.2.1.7 take up any references in relation to a Job seeker; or,

4.2.1.8 make any arrangements for accommodation of Job seekers.

4.2.2 The Conduct of Employment Agencies and Employment Business Regulations 2003 (the "Regulations") and Amendment of 2016  seek to ensure that Job seekers are only proposed by employment agencies for roles for which they are properly qualified and that recruiters are only offered Job seekers who have the appropriate levels of experience, training, qualifications and authorisation for the position to be filled. 

4.2.3 Since we are only a venue and do not propose, recommend  or introduce Job seekers to Employers or vice versa, it is recommended that, if you are a Job seeker you undertake the steps set out in the Regulations to ensure your suitability for the role advertised or, if you are an Employer, to ensure a Job seeker's suitability for the role.

4.2.4 Any searching or screening tools provided by us for use in your assessment of the suitability or otherwise of any particular Job seeker or advertised vacancy are to assist you in taking these steps but are not intended as a substitute.

4.3 External sites

4.3.1 Where R4G uses external links, we accept no responsibility for the content of third-party websites.

4.3.2 R4G may allow third parties to use a link to our website, provided it is done fairly and legally. However, any suggestion that R4G endorses or sponsors a third-party website or activity is strictly forbidden without our prior consent.

4.3.3 R4G may withdraw permission to link to our website at any time and without notice.

4.4 Service availability

4.4.1 We try to ensure continuous availability of the site and all the Services available on it but accept no responsibility for the consequences of interruptions or delays, however caused. We may, additionally, alter the design and specification of the site at any time. 

4.4.2 In exceptional circumstances, the R4G website may be inaccessible due to maintenance, a technical error or other unforeseen circumstances. We do not accept any liability if this site is temporarily or indefinitely unavailable.

4.5 Limitation of liability

4.5.1 Our liability, and the liability of our third-party suppliers, for any loss or damage suffered by you as the result of your use of this site is limited to your actual direct damages and, except in the case of fraud, excludes any loss of future earnings, profit or prospects or any consequential or speculative loss. As required by law, this exclusion does not extend to death or personal injury caused by our negligence. 

4.5.2 R4G will not be liable for any direct or indirect loss or damage arising from these Ts & Cs, or in connection, in any way, with our website.

4.5.3 The information posted on this website is indicative only and should not be considered as legal advice or used as a substitute for the advice of a qualified legal adviser.

4.6 Accuracy

4.6.1 While R4G does its utmost to guard against inaccuracies and typographical errors on our website, we accept no liability for any that are present, but will endeavour to correct them once we are aware.

4.7 Intellectual property

4.7.1 R4G operates this website and, unless otherwise stated, owns the intellectual property rights to all material on the site. This material is protected by copyright laws and all rights are reserved.

4.7.2 R4G agrees that you may download or print pages from this website for your own personal use, subject to the following restriction:

4.7.3 You do not reproduce, or allow anyone else to reproduce any material from the site, including to another website.

4.8 Cookies

4.8.1 The R4G website uses browser cookies; this means our web servers put small files (the 'cookies') onto your computer to collect information as you use the website. Cookies enable R4G to monitor traffic, remember users and their preferences and to provide features to users across multiple web servers.

5 FOR JOB SEEKERS USING OUR SERVICE

 

5.1 Who is eligible to use the site?

5.1.1 Any Job seeker registering to use this website’s Services, you undertake that you are over the age of 18 years.

5.1.2 We in turn undertake that Employers advertising on our job board have registered first with R4G.  

5.2 Children and minors

5.2.1 R4G is not directed towards individuals under the age of eighteen (18).

5.3 Retention of data

5.3.1 R4G Job-seeker data – any accounts that are inactive beyond a 12 month period will be automatically deleted from the site. We define inactive, as accounts that have not had any sign in activity within the given period.

5.4 CVs and job advertisements

5.4.1 CVs and job advertisements contained on the site are provided by Job seekers and are not reviewed by us. We accept no responsibility or liability for the contents of CVs or advertisements and expect Job seekers and prospective Employers to carry out such verification procedures as are customary and prudent in the circumstances. 

5.5 Your CV and profile information

5.5.1 Your information, including Personal Data, gets placed on the site when you upload or edit a CV or use our Profile Builder, which becomes part of your R4G profile. At your direction, R4G may send your CV to third parties if you choose to apply for a job listing. The extent to which your information is made available to third parties depends on the privacy settings you choose on your profile setting, in accordance with our Privacy Policy. When a Job seeker creates a profile on R4G, their CV is set to public by default. You can update your profile and CV privacy settings at any time from within your User account under the ‘My Job seeker profile>Privacy settings’ section.  Privacy settings are detailed below.

5.5.2

When “Make my profile available to employers, however I will decide who can see my CV” is selected
5.5.2.1 CVs are only made available to those Employers to whom the Job seeker has initiated an application or provided their CV. Where this occurs, you make your CV, your name and other Personal Data that you place on your resume available to third parties. Those third parties may be interested in you as an employee and may forward your CV to other third parties.

When “Make my profile and CV available to employers” is selected:
5.5.2.2 Your profile and CV are available to any registered employer. Where this occurs, you make your CV, your name and other Personal Data that you place on your CV available to third parties. Those third parties may be interested in you as an employee and may forward your CV to other third parties.

When ‘I do not want my profile or CV to be available to employers’ is selected:
5.5.2.3 Your profile and CV will not be available to any registered Employer and will only be passed on to them when you apply for a job via the R4G website.

 

5.6 Our services

5.6.1 Services and information provided on the R4G website by us, Employers or our third-party suppliers, are intended to assist in the job seeking, training or recruitment process. Neither we nor our third-party suppliers nor the Employers can guarantee the suitability of advertised roles nor prospects of success in any particular case. You should obtain independent verification before relying on information provided on the site in circumstances which may result in loss or damage. 

5.6.2 You acknowledge and agree that you are solely responsible for the form, content and accuracy of any CV or material contained therein placed by you on the R4G site. You should be aware (subject to the contact details you provide) that you may be contacted directly by Employers by email, post or telephone.

5.6.3 R4G does not discriminate against anyone registered to or using the R4G website. We try to ensure that all possible measures are taken to prevent any vacancies advertised or searches from discriminating against age, sex, race, religion or belief, disability, pregnancy or maternity, marriage & civil partnership, sexual orientation and gender reassignment. The search tools in place on the site do not have the functionality to exclude any Job-seekers with disabilities. It is down to the Users themselves to ensure they comply with discrimination laws.

5.6.4 Our liability, and the liability of our third-party suppliers, for any loss or damage suffered by you as the result of your use of this site is limited to your actual direct damages and, except in the case of fraud, excludes any loss of future earnings, profit or prospects or any consequential or speculative loss. As required by law, this exclusion does not extend to death or personal injury caused by our negligence.

5.6.5 You understand and acknowledge that you have no ownership rights in your account and that if you cancel your account or your account is terminated, all your account information from R4G, including CVs, Profiles, cover letters, saved jobs, questionnaires will be marked as deleted and will be deleted from R4G 's databases within a reasonable time period. Third parties may retain saved copies of your personal data.

6 EMPLOYERS USING OUR SERVICE

6.1.1 Creating an Employer profile and advertising jobs on this site is A DONATION of £20 charge towards the charity Anxious Minds.

6.1.2 Please note that if you are a recruitment agency, you can advertise jobs on this site where you are employing people directly within your organisation, or advertise jobs on behalf of clients if you cover the donation.

6.1.3 CV download is not available to recruitment agencies.

6.1.4 It is the Employer’s responsibility to notify us at info@anxiousminds.co.uk if there has been a change in any of their account details, incl. change in primary contact.

6.1.5 R4G Employer data: your Employer data will be held for as long as the account is active. Your account will be deemed as active for as long as you are compliant with these T&Cs or until you request for your account to be deactivated or deleted.

6.1.6 We do not guarantee any response to your advertisement or that responses will be from individuals suitable for the job advertised. It is your responsibility to carry out such checks and procedures as are necessary to ensure that Job-seekers are suitable for the job advertised and have the required qualifications and personal characteristics.

6.1.7 On receipt by us of your submitted information via our on-line form or Employer registration via the website, you will be deemed to have accepted all of these terms and conditions, and will be granted access to our database in accordance with these Ts & Cs. You also agree that all the information you supply to us is correct, truthful and complete. You agree to inform us by email, telephone or post of any changes to any of the information supplied by you to us. We reserve the right to terminate this agreement in the event that any of the information provided by you to us, is no longer current or accurate or in the event you are in breach of these Ts & Cs.

6.1.8 We will take reasonable steps to provide a reliable service to you. However, we cannot guarantee the accuracy or authenticity of any of the CVs stored in our database. You acknowledge and accept that this is beyond our control.

6.1.9 All information provided to you by us is confidential and you will not disclose your username and/or password to any persons outside of your company. If disclosure occurs we reserve the right to terminate this agreement immediately and seek compensation. Passwords are for the sole use of the person who registers the Employer account. Passwords must be kept confidential and secure. 

6.2 Illegal advertisements

6.2.1 Advertisements which appear to discriminate on grounds of age, sex, race, religion or belief, disability, pregnancy or maternity, marriage & civil partnership, sexual orientation and gender reassignment are illegal and may result in proceedings being taken against both the advertiser and the publisher. Advertisements are accepted by R4G on the basis that the advertiser confirms that any requirement or qualification which may appear to discriminate illegally is in compliance with any exemption available under the relevant legislation. Notwithstanding this confirmation, if we nonetheless believe that an advertisement may be discriminatory we may at our discretion either amend the advertisement or remove it from the R4G website without liability to you to make any refund of amounts paid or due to be paid in respect of the posting or otherwise and will inform you accordingly. 

6.3 Complying with local laws & data protection

6.3.1 It is the Employer’s responsibility to ensure that they are complying with the local recruitment and employment legislation.

6.3.2 You acknowledge and accept that all rights to information provided by third parties are reserved by those third parties, and that such information may not be used in any way that infringes any proprietary interests of those third parties. You agree not to disclose any information provided by the Job-seekers to any third parties, or those not directly related to the recruitment process of the individual(s) in question.

6.3.3 You acknowledge and accept that you will at all times comply with the provisions of current data protection legislation. And you will not, by any act or omission cause R4G to be in breach of current data protection legislation.

6.3.4 You acknowledge and accept that once R4G has transferred personal data relating to Jobseekers to you, you are acting as a data controller in your own right for the purpose of current data protection legislation in connection with any personal data obtained in the provision of the Services by R4G. It is your responsibility to comply with your obligations as a data controller including (but not limited to’): identifying the applicable lawful purpose for processing the personal data, complying with data subject rights, complying with GDPR (UK and EU, where applicable) and DPA 2018 processing principles, reporting data breaches to the ICO, complying with all legal time limits in respect of data subject rights and data breaches. 

6.3.5 R4G acknowledges that it will act as a data controller for the purposes of current data protection legislation when processing personal data within its control and that it will comply with its legal obligations in the provision of the Services.

6.3.6 Any personal details which you provide to us from which we can identify you are held in accordance with our Data Protection Registration. You are obliged to have a lawful basis for the transfer of any personal data you provide to us. You agree that you do not object to us using this information to contact you for the purpose of improving our service to you, discussing account status, and you confirm that you do not consider any of the above as a breach of any of your rights under the  Privacy and Electronic Communications (EC Directive) Regulations 2003 (as amended). 

7 GOVERNING LAW

These terms and conditions shall be interpreted in accordance with English law and all disputes shall be decided by the English courts. 

 

8 BROWSER POLICY

R4G’s website supports the current and most recent previous versions of all popular browsers and follows the HTML 4.01 (loose) and CSS 2.1 W3C standards. If your browser is not supported, you may still be able to access our site, but you may encounter some display problems.
